Aerial Photography and the Law

Unless you've been living off the grid, held up in a cabin somewhere, you've probably seen an image or video from a drone. However, what you don't know about drone laws will probably come back to bite you. As the owner of a South Florida business that provides aerial photography services for real estate listings, it has always surprised me how little most people really know about the laws and government regulations that guide commercial sUAS ( drone ) operations. I've had countless customers that are shocked when I tell them I can't take aerials of this property today because I need to file for an authorization. The proceeding comments range from, "Why did the other guy never tell me that" to "Just go about 30 feet high" or even "It isn't a big deal, is it?" Unfortunately, I really don't know what the other guy was doing, maybe he already had an authorization, maybe he was flying commercial illegally and is either unaware or chooses not to obey. The reality of the situation is that it is a big deal and the consequences of civil penalties etc, far outweigh the risks involved. I would urge anyone that is going to hire a company for real estate or aerial photography to practice due diligence by asking the right questions. Any legitimate aerial photographer will have no problem showing you their FAA Remote Pilot rating/ license, don't hire someone if they can't produce it.

To finalize this entry I would like to share you some tips that can help you hire the right aerial photographer:

1- Ask them to provide you with their FAA Remote Pilot Rating / License

2- Request examples of past projects (ask them for pictures and videos) as this will give you a better idea of the quality of work.

3- Get involved! Make sure you take an active role in the process. Ask questions, provide the aerial photographer with specific details of the vision you have and communicate your ideas clearly. This would definitely help you obtain the results you desire.
